A coalition of pro-life organizations, led by Advancing American Freedom (AAF), filed an amicus brief in Missouri v. FDA, supporting states’ authority to regulate abortion.
The case challenges the FDA’s decision to relax safety requirements for mifepristone, the chemical abortion drug used in 60% of U.S. abortions. Since 2021, the FDA has allowed prescriptions without an in-person visit, enabling the mailing of abortion drugs into states with pro-life laws.
The brief argues that under the Tenth Amendment, states retain the power to enact and enforce abortion regulations. Pro-life advocates say the FDA’s changes undermine state laws designed to protect women and the unborn, and that states have standing to challenge federal policies that conflict with their laws.
