The Trump administration’s Department of Health and Human Services has formally rescinded 2022 guidance that attempted to reinterpret the Emergency Medical Treatment and Labor Act (EMTALA) as requiring emergency room doctors to perform abortions.
The Centers for Medicare & Medicaid Services confirmed the rollback, stating the Biden-era guidance “does not reflect the policy of this Administration” and reaffirmed that EMTALA protects both the pregnant woman and her unborn child.
In light of this policy shift, Alliance Defending Freedom attorneys have voluntarily dismissed their lawsuit filed on behalf of the Catholic Medical Association, which challenged the mandate for violating conscience rights and exceeding the agency’s statutory authority.
