In a historic 6-3 ruling, the U.S. Supreme Court granted the Thomas More Society’s emergency petition in Mirabelli v. Bonta, striking down California’s policies that required schools to conceal children’s gender transitions from their parents.
The Court held that the state’s secret transition regime likely violates parents’ rights under the Free Exercise Clause of the First Amendment and the Due Process Clause of the Fourteenth Amendment.
The decision reinstates a class action injunction protecting parents statewide, ensuring that schools cannot facilitate a child’s gender transition without parental knowledge or consent. The Court emphasized that parents, not the state, hold primary authority over the upbringing, education, and mental health decisions for their children.
“This is a watershed moment for parental rights in America,” said Paul M. Jonna of the Thomas More Society. The ruling sets a nationwide precedent, dismantling secret gender transition policies and reinforcing parental authority over children’s well-being.
