MA House moves to shield abortion providers from out-of-state scrutiny

The Massachusetts House voted 130-29 to pass the Shield Act (H.4271), legislation designed to protect abortion and transgender medical procedures within the state.

 

The bill aims to strengthen "healthcare" protections by preventing state agencies, law enforcement, and electronic health record companies from cooperating with investigations from other states or the federal government into reproductive and gender-affirming care in Massachusetts.

The Senate has already approved a different version of the bill, and a House-Senate conference committee will work to create a final compromise.

The bill also includes provisions to safeguard patient data, protect healthcare providers from discipline related to reproductive or transgender issues, and prohibit insurance discrimination against nonprofits offering these services.

MCFL President Myrna Maloney Flynn stated: "Those who voted in favor of H.4271 have not only encouraged Massachusetts physicians to break abortion laws in other states but have also approved protecting their illegal activities as well. Going forward, MA abortionists who prescribe mifepristone to women in areas where it is outlawed have more ways to hide their crimes and conceal their identities. The bill goes far beyond protecting unethical doctors, though; it all but assures the inability to hold accountable those physicians whose actions result in serious injuries to women who consume the abortion pill without any medical oversight. We look forward to the likely federal response in the coming weeks."
